Dr. Jain is going beyond her scope to help the Constitution of this Country.
The First Amendment provides you with the right to represent yourself to redress the grievances against the Government but that right has no meaning if the self-representing citizens are not given equal opportunity, equal protection, and justice for all. The Case Management and Electronic Court Filing (CM/ECF) system of the Federal Court is only accessible to the citizens who are represented by lawyers and not to the self-representing citizens. Pro se litigants have a right to represent themselves in the federal court but are not allowed to file documents electronically via Case Management/ Electronic Court Filing System (CM/ECF). Pro se litigants can receive the orders only by mail and can ONLY be allowed to file electronically with permission from the court. Receiving the orders in real-time electronically will give the citizens the same benefit as those represented by counsel and allow the case to proceed more efficiently. Orders cannot be received instantly in real-time like the attorneys will get and can be received only via mail and can take up to five to seven days.
Access to electronic filing is especially important during the national emergency and stay-at-home order by Governor DeSantis and the Mayor of Orlando. The Judges and attorneys deny them access to the electronic filing system of the court. do not consider safety for the lives of the self-representing citizens. The electronic filing would provide no risk to exposure to coronavirus but furthermore, the suggestion to send the filing via US mail conflicts with the CDC Guidelines. Submitting the documents via US mail would require a visit to the US Post Office. and this advice creates a high risk of exposure to COVID-19 for high-risk citizens who must stand in the line with the general public, obtain postage rate and stamps according to the weight from a clerk, and touch surfaces not sanitized. Thus, mailing has a huge risk of exposure. Judge Carlos Eduardo Mendoza, Article III Judge, and Magistrate Leslie Hoffman have denied the electronic filing to pro se in the Federal Case in the Middle District of Orlando. The same Middle District Court in 2019 has granted the electronic privilege to White Pro se but Judge Carlos Eduardo Mendoza did not grant the same electronic filing to a pro se of color. Standing up against the violation of statutory rights is not easy but it is necessary to keep the Justice System of America great. All the citizens must stand up for the constitution and make the people accountable for their violations otherwise with abuse of power; they would not face any consequences but will be rewarded for their wrongdoings. (That happens only in third-world countries.)
